Living Wills.

Your Will.

The preparation of your Will affords you peace of mind. Without a Will, you cannot control what happens to your Estate when you die and you cannot choose who is to manage your affairs, as Executor, after you die.

Your personal possessions or treasured items may not go to those whom you would like to benefit and your Estate is instead divided in accordance with Statutory Intestacy Rules, which may well not accord with your wishes.
If you have been involved in a divorce or separation, if you have stepchildren, or if you are not married to your partner, you will especially require careful consideration in the preparation of your Will to avoid your family being faced with claims upon your Estate from those whom you do not wish to benefit.
Making a Will is an opportunity to deal with these matters and can also set out any special wishes you have with regard to your funeral arrangements.

    Living Wills.

    Living Wills may be of comfort, allowing an individual of sound mind to indicate circumstances in which they do or do not wish to continue with medical treatment and to give them the opportunity to appoint an individual who can liaise with and assist medical professionals at a time of crisis.
    We will discuss with you your options and prepare your Living Will to take into account your personal circumstances.

  • Lasting Powers of Attorney (LPAs). 

    A Lasting Power of Attorney (LPA) can relate to both Health and Care Decisions and Financial Decisions, allowing you to appoint someone to make those decisions on your behalf. Without a Lasting Power of Attorney it would be necessary to apply to the Court of Protection for a Court Appointed Deputy to act when you are unable to, if you lack capacity to make decisions yourself or are physically unable to do so.
    Applications to the Court of Protection can be lengthy and expensive. A Lasting Power of Attorney can help you avoid this cost, delay, inflexibility and uncertainty and simplify matters for you in the future, providing great comfort to you and your family in times of need.

  • Inheritance Tax & Care Home Fees. 

    Where it is applicable Inheritance Tax is charged at 40% and Care Home Fees can run to many thousands of pounds per month. Given the potential impact upon your savings, assets Estate, it is very important to properly organise your affairs in order to secure the maximum benefit for you during your lifetime and for your beneficiaries after your death and, wherever possible, to minimise the impact of Inheritance Tax and Care Home Fees.

    We will be pleased to advise you in respect of each matter and our fees will be clear, transparent, advised to you at the outset and our advice will be tailored to your particular circumstances.

  • Inheritance Act Claims/Contesting an Estate.

    While a person may leave their Estate to whoever they wish in their Will, the law does make provision for those who might reasonably expect an Inheritance but are excluded or receive less than they need. The Inheritance (Provision for Family and Dependants) Act 1975 (The Inheritance Act) seeks to protect those who are financially dependent on another person who then dies without leaving them with a sufficient inheritance for their needs. Claims can also be made where no Will exists and the Rules of Intestacy have been applied. In successful claims The Inheritance Act allows the Court to change the way the Estate is distributed.

    We can advise those making a Will in order to minimise the potential impact of a claim under The Inheritance Act.

    We can also advise upon making a claim on behalf of those who have been excluded from a Will, who have not been left as much as they were expecting or do not inherit due to the Rules of Intestacy.
