Who are the NHS Counter Fraud Authority? 

NHS counter-fraud investigations are conducted by the NHS Counter-Fraud Authority who investigate allegations of fraud, bribery and corruption within the NHS. Whilst some minor investigations can be closed quickly, in more serious cases, there is a risk that the matter will be referred to the criminal courts. How do the NHS Counter Fraud Authority investigate cases? 

NHS practitioners or staff who face an investigation may be invited to be formally interviewed under the Police and Criminal Evidence Act (also known as a ‘voluntary interview, an interview caution or a PACE interview’ or in the more serious allegations, the police may be involved, leading to an arrest. Either way, an interview will take place where the allegations will be put to the person under investigation allowing them the opportunity to respond as part of the investigation.

Do I need a solicitor to attend an NHS Counter Fraud interview under caution? 

We do not advise attending a voluntary interview on your own and often hear from people following the interview seeking our assistance as they regret going alone. We will be able to liaise with the investigator for you, request pre interview disclosure and advise you how best to proceed. We often find that attending the interview with a solicitor demonstrates that you are taking the matter seriously and are committed to your job having invested in the right representation. It must be remembered of course that even where NHS Counter Fraud does not bring criminal charges, the evidence obtained may nevertheless be passed to the General Medical Council (GMC), The Nursery and Midwifery council (NMC), General Dental Council (GDC), General Optical Council (GOC) or other regulators to investigate further.
