Mental capacity refers to a person's ability to make decisions for themselves. In order to set up a power of attorney, you must have the mental capacity to understand the nature and effect of the document.

Types of Powers of Attorney

There are different types of power of attorney, including:
● General power of attorney: This type of power of attorney gives the person you appoint (your attorney) the authority to handle a wide range of matters on your behalf.
● Lasting power of attorney (LPA): An LPA is a more specific type of power of attorney that allows your attorney to make decisions about your property, financial affairs, and/or health and welfare if you are no longer able to make those decisions for yourself.

Types of Lasting Powers of Attorney

There are two types of LPA:
1. Property and financial affairs LPA: This type of LPA allows your attorney to make decisions about your property and financial affairs, such as paying bills and managing your bank accounts.

2. Health and welfare LPA: This type of LPA allows your attorney to make decisions about your healthcare and personal welfare, such as where you live and what medical treatment you receive.

To set up a power of attorney, you must complete a power of attorney form and have it witnessed and signed by a solicitor or other suitable person. You will also need to appoint someone to be your attorney, who must be over 18 and have the mental capacity to make decisions for themselves.
